Information on the Site regarding Areté’s supply chain planning and scheduling software products is provided for general informational purposes only. The features, specifications, and pricing described on the Site are subject to change without notice. Use of Areté’s software products is governed by separate license agreements and service contracts.
5. Disclaimer of Warranties
The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Areté disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
6. Limitation of Liability
To the maximum extent permitted by law, Areté Inc., its directors, officers, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Site, even if we have been advised of the possibility of such damages. Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us, if any, during the twelve (12) months preceding the claim.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that Areté is not responsible or liable for any damage or loss caused by the use of such third-party content.

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Mercer County, New Jersey.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
